Bacula Systems SA files Lawsuit Against Bareos GmbH & Co. KG

Bacula Systems SA has today filed a lawsuit against the new German company Bareos GmbH & Co. KG and one of its directors for copyright infringement and unfair competition related to the alleged unauthorized and undue exploitation of part of the source code of the Bacula Enterprise.

Sections of the Bacula Enterprise source code appear to have been copied without permission into the Bareos software. Bacula Systems has tried for some months to resolve this infringement and a number of others with Bareos. Despite the obvious copying visible in the Bareos software and the fact that one of their Managing Directors had previously worked closely for some years with the Bacula development team, downloading major sections of the Bacula Enterprise source code before and after becoming a Bareos Managing Director, Bareos and he have repeatedly denied having any copies of the Bacula Enterprise source code. As a result, Bacula Systems had no other choice but to take all necessary steps to protect its intellectual property.

By the present notice, Bacula considers it important to draw users’ attention to the fact that any download and use of the Bareos software would necessarily lead to the unauthorized reproduction and distribution of the Bacula Enterprise source code and consequently lead any such user to actively participate in such infringements. To avoid any such undesirable outcome, Bacula Systems encourages such users to contact the undersigned to discuss the likely implications for them directly.
